Poze and its affiliates and subsidiaries, meaning companies related to us by common ownership or control (collectively, “Poze,” “we,” ”us,” “our”) respect your (the “user,” “you,” the “user’s,” or “your”) right to privacy and strive to maintain the confidentiality of your personal information. This Privacy Policy describes in greater detail our privacy practices for collecting and maintaining certain information about you. This Privacy Policy applies to all versions of our applications, website www.poze.app , and all of our products, services, websites, media forms and/or channels (collectively, the “App”).

We may change this Privacy Policy from time to time. If we make changes, we will notify you by revising the date at the top of the page. We require you to read and agree to this Privacy Policy when you download and install the App or visit, access or utilize Poze’s services in any way. By taking any of these actions in relation to Poze, you are representing to us that you have fully read, understand, and agree to our Privacy Policy.  

Poze is a company designed to help singles meet each other while doing good for meaningful charities and other nonprofits, and the people and causes the nonprofits serve. We provide services to you, our user, and we also maintain relationships with other nonprofits, as well as with for-profit businesses. We encourage you to review the Privacy Policy whenever you access the App to understand how these various relationships involve the collection, maintenance, and occasionally sharing of your information. 

1. Application of this Privacy Statement

This Privacy Policy (the “Privacy Policy”) applies to our App, products, and related services whether or not they link to this Privacy Policy. Poze is the responsible entity for all Personally Identifiable Information subject to this Privacy Policy for any services provided to users anywhere in the world. 

2. Information We Collect

Individual users and nonprofits make up the community we serve. We may collect the following limited information from our users through the following channels: 

  • We ask our users for personal information such as demographic information, physical characteristics, gender identity and sexual preferences to strive to find them compatible dates. 

  • We enable our users to post audio, video, and other information when creating their accounts and at other times during their use of the App. 

  • We ask our users for financial information, such as credit cards, to process payments. 

  • We ask our users which nonprofits they like or prefer, to process donations and for other charitable purposes. 

  • We ask our users for government identification documents or information in order to undertake background checks for safety. 

  • We ask our users for information such as phone number, e-mail address and physical street address in order to create an account and so we can maintain communication with our users. 

  • We ask our users to create user names or identities, and, to assign passwords to those names or identities to facilitate the creation of an account. 

  • Our users may post content (“User Content”) through the App subject to certain reasonable restrictions on such User Content, for example, no bullying, harassment, use of profanity, violation of other users’ civil rights or other rights, etc. Such information remains the intellectual property of the user, however, Poze is granted a lifetime, worldwide, irrevocable license to the User Content for marketing and analytics purposes. 

  • We maintain a helpdesk function for addressing any questions, comments or concerns about the App. We may access users’ e-mail addresses and any other information they elect to provide as part of responding to such inquiries. Information gathered through the help desk is only utilized for customer support, and only stored for recordkeeping and analytics purposes.

  • We may from time to time collect automatically-generated information when you access our services (“Usage Data”), such as browser information, link interaction with our products, Internet Protocol (“IP”) addresses, and any other usage information collected from cookies and other tracking tools. 

  • We may also, when you enable location-based services, collect Global Positioning System (GPS) location data and/or motion data. 

  • We describe how certain automatically-generated information is collected by “Cookies” in more detail in the How We Use Your Information Section, below. 

3. How We Use Your Information 

We use your information for legitimate business purposes connected with the App and our mission, including but not limited to creating and managing your account, providing customer support when you need it, and helping you form meaningful connections with other users. 

We also use your information to analyze your and other users’ preferences and behaviors, to continue developing a better user experience. We also access, process and store your information to ensure compliance with the law, and so that we are able to provide a timely and appropriate response in the event of any issues such as fraud or harassment. 

4. Information Collection through Cookies 

We use and may allow others to use cookies and similar technologies (e.g., web beacons, pixels, collectively “Cookies”) to recognize you and/or your device(s). Some of our reasons for using Cookies are for authenticating you, remembering your preferences and settings, delivering and measuring the effectiveness of marketing efforts, analyzing trends and traffic, allowing you to use special features of our App, and optimizing your overall experience with us. 

Some web browsers (including Safari, Internet Explorer, Firefox and Chrome) have a “Do Not Track” (“DNT”) feature that tells a website that a user does not want to have his or her online activity tracked.  If you choose to utilize this feature, some of the features connected with the App may not work optimally or at all. 

5. Information Disclosure to Third Parties

We limit any sharing of information we have collected about you to certain narrow purposes. Your information may be shared for the following reasons only:

TO COMPLY WITH LAWS OR TO PROTECT RIGHTS OF USERS

If we believe the release of information about you is necessary to respond to a legal process, to investigate or remedy potential violations of our policies, or to protect the rights, property, or safety of others, we may share your information as permitted or required by any applicable law, rule, or regulation. This includes exchanging information with other entities for fraud protection and credit risk reduction.

TO CONNECT USERS WITH THIRD-PARTY NONPROFITS

We may share your information with charities and other nonprofits you indicate you are interested in, or, with other nonprofits which we believe may align with your expressed interests. We maintain agreements with these nonprofits with whom we provide your information that they must provide you an “opt-out” option if you indicate that you do not wish to receive communications from the nonprofits. If you are having difficulty opting out of nonprofit communications that you believe were initiated by or through your use of the App, please contact our help desk and we will make every effort we can to provide you with assistance.  

TO ASSIST THIRD-PARTY SERVICE PROVIDERS

We may share your information with third parties that perform services for us or on our behalf, including but not limited to payment processing, data analysis, e-mail delivery, hosting services, customer service, and marketing assistance.

TO PERFORM ANALYSIS AND MARKETING STRATEGIES WITH OTHER THIRD PARTIES

We may share your information with advertisers and investors for the purpose of conducting general business analysis. We may also share your information with such third parties for marketing purposes, as permitted by law.

TO TRANSFER ASSETS IN THE EVENT OF SALE OR BANKRUPTCY

If we reorganize or sell all or a portion of our assets, undergo a merger, or are acquired by another entity, we may transfer your information to the successor entity. If we go out of business or enter bankruptcy, your information would be an asset transferred to, or acquired by, a third party. You acknowledge that such transfers may occur and that the transferee may decline to honor the commitments we’ve made in this Privacy Policy.

TO UTILIZE API INTEGRATION WITH SOCIAL MEDIA PROVIDERS 

Our interaction with third parties is highly limited as set forth in this Privacy Policy. From time to time, we may integrate or otherwise utilize API for social media through the App, but all users will be provided the opportunity to “opt in” or “opt out” of this function. 

6. Our Stance on Contact with You

We may from time to time contact you to remind you about something related to the App or to inform you of other great services we have in the works through “push notifications” or similar means. If you do not wish to receive notifications, you will be provided an “opt-out” option. 

We may also contact users in other ways such as e-mail or text message with promotional materials, newsletters, and offerings from us or from third parties. You will be provided an “opt-out” option if you do not wish to take advantage of these communications. 

7. How We Keep Your Personal Information Safe

We use reasonable administrative, technical, and physical security measures to help protect your information. While we have taken reasonable steps to secure the information you provide to us, please be aware that despite our efforts, no security measures are perfect or impenetrable, and no method of data transmission can be guaranteed against every interception or other type of misuse. Any information disclosed through the web is vulnerable to interception and misuse by unauthorized parties. Therefore, we cannot guarantee complete security if you provide us your information.

8. Location of Servers 

If you access the App inside or outside of the United States, please note that we will store any information about you referenced in this Privacy Policy, including your User Content, on secure servers at one or multiple locations. 

9. Your Rights with Regard to Information We Collect about You

You have the following rights with regard to information about you:

  • The right to be informed about what kind of information about you is collected, stored, processed and disclosed by us; therefore, we have compiled this Privacy Policy for you. 

  • The right of access (you can request us to provide you verbally or in writing with the type of information we store about you and we have up to one month to respond to your request). 

  • The right to rectify any Personally Identifiable Information that is inaccurate.

  • The right to erasure (some conditions apply, see Section Data Retention Section, below). 

  • The right to restrict processing of your Personally Identifiable Information, however, if you restrict us from processing a part of your Personally Identifiable Information that is essential to our provision of services, you may be asked to terminate your account and stop using our services. 

  • The right to data portability; which allows users of our App  to obtain and reuse their Personally Identifiable Information for their own purposes as they see fit, including across different other services; you may request us to transmit your Personally Identifiable Information directly from our servers to another company’s servers and we will do so, where it is technically feasible. 

  • The right to object; you may express your objection verbally or in writing and we have up to one month to respond to any such objection; we might may still continue processing your Personally Identifiable Information if we are able to show that we have a compelling reason for doing so. 

  • The right not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning you or that affects you significantly.

10. Data Retention Policy

Your Personally Identifiable Information will be erased when: (i) it is no longer needed for its original processing purpose; (ii) you withdraw your consent for us to store your information by deleting your account; (iii) there is no justified reason for the processing of your Personally Identifiable Information and you object to our processing of your Personally Identifiable Information; or (iv) erasure of your Personally Identifiable Information is required in order to fulfill a statutory obligation under the EU, US, or state law or the right of the EU Member States. Under any of the above-mentioned circumstances, we will make sure your Personally Identifiable Information is erased. You may request us to erase your Personally Identifiable Information verbally or in writing and we have up to one month to respond to any such request. 

11. Policy Regarding Children 

We do not knowingly solicit information from or market to children under the age of 18. If you become aware of any data that we have collected from children under age 18, please contact us using the contact information provided below.

12. General Compliance with Laws 

Our Privacy Policy complies with the strictest laws on handling of Personally Identifiable Information. Such laws include: the USA’s Children's Online Privacy Protection Act (COPPA), the European Union’s General Data Protection Regulation (GDPR), and the California Consumer Privacy Act (CCPA).  When and if stricter privacy and data laws are enacted, we are committed to staying apprised of their requirements, and to updating our Privacy Policy to ensure its compliance with or exceeding of such requirements. 

14. Compliance with California Laws 

For Users who are California residents, you have the following rights under the California Consumer Privacy Act, and you have the right to be free from unlawful discrimination for exercising your rights under the Act:

  • You have the right to request that we disclose certain information to you and explain how we have collected, used and shared your personal information over the past twelve (12) months; and

  • You have the right to request that we delete your personal information that we collected from you, subject to certain exceptions.

California’s “Shine the Light” law, Civil Code section 1798.83, requires certain businesses to respond to requests from California customers asking about the businesses’ practices related to disclosing personal information to third parties for the third parties’ direct marketing purposes. If you wish to find out about any rights you may have under California Civil Code section 1798.83, you can write to us at privacy@poze.app.

In addition, under California law, operators of online services are required to disclose how they respond to “do not track” signals or other similar mechanisms that provide consumers the ability to exercise choice regarding the collection of personal information of a consumer over time and across third party online services, to the extent the operator engages in that collection. At this time, we do not track our Users’ personal information over time and across third-party online services. 

This law also requires operators of online services to disclose whether third parties may collect personal information about their users’ online activities over time and across different online services when the users use the operator’s service. We do not knowingly permit third parties to collect personal information about an individual User’s online activities over time and across different online services when using the App.
